Terms & Conditions

These Terms and Conditions (“Terms”) govern all studio sessions, artwork purchases, gift certificates, and related services provided by Fairytale Photography Studio (“the Studio”). By scheduling an appointment, participating in a program, or purchasing artwork, you agree to be bound by these Terms.

The Studio reserves the right to modify or update these Terms at any time. The most current version will always be available at www.fairytalephotographystudio.com.

1. Gift Certificates
Gift Certificates must be redeemed before the expiration date printed on the certificate and are valid only for the person listed. Certificates may not be combined, sold, or exchanged for cash. If a Certificate is associated with a specific session type, it must be redeemed accordingly.

2. Appointment Scheduling and Deposits
A refundable deposit is required to reserve your portrait session and viewing appointment. Your deposit will be refunded when both appointments are completed as scheduled. If you miss, cancel, or reschedule an appointment without sufficient notice, your deposit may be forfeited. Clients who arrive more than 15 minutes late may be asked to reschedule, and deposits may not be refunded due to scheduling impacts on other clients.

3. Rescheduling and Cancellations
Gift Certificates entitle the holder to one scheduled appointment only. Rescheduling is at the Studio’s discretion and subject to availability. If the Studio must reschedule due to unforeseen circumstances, your session will be rebooked at no cost.

4. Extended Family and Group Sessions
Sessions are designed for immediate family members or siblings. Extended family sessions (e.g., cousins, grandparents, or large groups) may require a consultation and additional session fee. Gift Certificates cannot be applied to extended family sessions.

5. Artistic Control
The Studio retains full artistic control over all session styling, composition, artistry, and final image selection. Fairytale Photography Studio reserves the right to decline requests that conflict with the Studio’s brand aesthetic or professional standards.

6. Copyright and Usage
All images created by Fairytale Photography Studio remain the exclusive copyright of the Studio. The Studio reserves the right to use images for display, marketing, and promotional purposes unless otherwise agreed in writing. Reproduction, scanning, or distribution of images without written consent is strictly prohibited.

7. Payment Plans and Artwork Delivery
Fairytale Photography Studio offers flexible payment plans to make fine-art purchases accessible.
Payment plans require a signed authorization form at the time of ordering. Artwork production begins once payment has been completed in full.
Physical artwork ships within 5–7 business days after production is complete. Digital files are delivered the same day the order is finalized.
Failure to complete payments according to the agreed schedule may result in collection action and associated fees.

8. Refund Policy
Due to the custom nature of portrait artwork, all sales are final. If your print arrives damaged or defective, the Studio will replace it at no additional cost. Deposits may be refunded according to Section 2.

9. Conduct and Right to Refuse Service
Fairytale Photography Studio maintains a safe, family-friendly environment. The Studio reserves the right to refuse or discontinue service to anyone whose behavior is disruptive, inappropriate, or disrespectful to staff or other clients.

10. Limitation of Liability
By participating in any session or program, you agree to hold harmless Fairytale Photography Studio, its owners, employees, and affiliates from any claim, damage, or injury arising from participation or use of Studio services, except in cases of proven negligence or misconduct.

11. Governing Law
These Terms are governed by the laws of the State of Texas. Any dispute arising from Studio services shall be resolved in a court of competent jurisdiction located in Harris County, Texas.
